PASO Council meeting

25.07.2024 the meeting of the PASO Council was held online.

The agenda did not include the issue of considering the Conclusions of the Qualification Commission on Disciplinary Proceedings. Only issues of organizing advocacy were considered.

The register of the Chamber of Advocates of the Samara Region has grown by one lawyer who took the oath. The PASO Council expressed its congratulations, T.D. Butovchenko traditionally expressed parting words and good wishes.

After that, the Council moved on to considering issues on the agenda.

Due to personal circumstances, in accordance with subparagraph 5 of paragraph 1 of Article 16 of the Federal Law "On Advocacy and the Bar in the Russian Federation", the status of one lawyer was suspended.

The status of three lawyers was resumed on the grounds of Part 5 of Article 16 of the Federal Law "On Advocacy and the Bar in the Russian Federation".

The status of two lawyers was terminated on the grounds of subparagraph 4 of paragraph 1 of Article 17 FZ "On Advocacy and the Bar in the Russian Federation" - in connection with the convictions that entered into legal force, finding lawyers guilty of committing intentional crimes:
- in one of the cases, the lawyer was subject to an administrative fine of 30,000 rubles for driving a vehicle while intoxicated and was deprived of his driver's license for a period of one and a half years. The fine was not paid. Subsequently, the lawyer was again detained for driving a car while intoxicated and sentenced to a punishment in the form of compulsory work in the amount of two hundred hours with deprivation of his driver's license for a period of two years.
- in the second case, the lawyer was convicted under Art. 159 Part 2 of the Criminal Code of the Russian Federation to imprisonment for a term of 2 years, 2 months and 10 days to be served in a general regime colony. By the appellate ruling of the judicial panel for criminal cases of the Samara Regional Court, the sentence was upheld unchanged.

The PASO Council satisfied the applications of: thirty one lawyers for inclusion in the system of providing subsidized legal aid; for entering information into the register of advocacy entities - one lawyer's office was established, and two lawyer's offices were liquidated.

The PASO Council reviewed the lawyer's appeal and provided clarifications regarding behavior in a specific situation: the expression of a position in criminal proceedings contrary to the will of the client is unacceptable on the part of the defense attorney, and this postulate is mandatory for every lawyer - subparagraph 3 of paragraph 4 of Article 6 of the Federal Law "On Advocacy and the Bar in the Russian Federation".
