Meeting of the PASO Qualification Commission

On February 11, 2021, a regular meeting of the Qualification Commission of the Chamber of Lawyers of the Samara Region took place.

Before the beginning of the meeting, the President of PASO T.D. Butovchenko, having greeted the members of the Qualification Commission, brought to the attention of the members of the Commission the topic of discussion of the Proposals for amendments to the Code of Professional Ethics of a Lawyer, received from the Commission for the development of amendments to the KPEA of the RF Federal Law Office and sent out in advance to the members of the Commission.

Special attention was paid to amendments concerning the procedural aspects of the consideration of disciplinary proceedings, respectively, in the Qualification Commission and the Council with the participation of their representatives in each of the bodies of advocate self-government.

The Qualification Commission was informed about the conclusions of two disciplinary proceedings, which were sent for reconsideration, in which, in the opinion of the PASO Council, part of the factual circumstances remained without the Commission's assessment.

The Commission considered forty-six disciplinary proceedings, two of which were initiated upon the request of the court, two - on the proposal of the Directorate of the Ministry of Justice of the Russian Federation for the Samara Region, thirty-six - on the proposal of the Vice-President of the PASO (of which thirty-three - based on the results of the verification of the execution of the Decisions of the PASO Council No. 14-11-08 / SP of November 27, 2014 "On approval of the rules for the provision of subsidized legal assistance by lawyers of the Chamber of Advocates of the Samara Region participating as defenders in criminal proceedings on the appointment of the inquiry bodies, preliminary investigation bodies or the court in accordance with Articles 50 and 51 Criminal -Procedural Code of the Russian Federation and as representatives in civil proceedings by appointment of a court in accordance with Article 50 of the Civil Procedure Code of the Russian Federation and Article 54 of the Code of Administrative Procedure of the Russian Federation "for the period from 01.01.2020 to 31.03.2020 in the Leninsky and Oktyabrsky districts x G.O. Samara, Central District Togliatti Syzran, municipal districts Bezenchuksky and Privolzhsky of Samara region, carried out by the decision of the Council of PASO No. 2-09-6.2 / SP dated 09.24.2020), six - on complaints of principals.

Based on the results of consideration by the Commission:
- two disciplinary proceedings were terminated due to the withdrawal of the complaint by the person who filed the complaint and the withdrawal of the court's appeal;
- nine disciplinary proceedings were terminated due to the absence in the actions (inaction) of lawyers of violation of the legislation on advocacy and the legal profession and (or) the Code of Professional Ethics of a lawyer, or due to the proper performance by lawyers of their duties to the client or the chamber of law;
- in thirty-two cases of disciplinary proceedings, violations of the legislation on the Bar and the Code of Professional Ethics of a Lawyer were found;
- one disciplinary proceeding was postponed for reasons recognized by the Commission as valid.

The measure of disciplinary liability in relation to lawyers, in whose actions the Commission found violations of the legislation on the legal profession and the Code of Professional Ethics of a Lawyer, will be determined by the Council of the Chamber of Lawyers of the Samara Region at a meeting that will be held on February 25, 2021.

25 applicants were admitted to the qualification exam for attorney status. The exam will take place on March 11, 2021.
