The cycle of free educational events has ended

The cycle of free training events on the topic: "Features of a lawyer's work in cases by appointment" has ended.

With a record number of listeners (a total of 906 lawyers took part) on November 15, 22 and 29, 2023, webinars were successfully held, and on December 6 - an in-person seminar. Considering that, according to statistics, there are 849 lawyers on the list of the Center for Subsidized Legal Aid PASO, we consider the task of conveying important information to every interested lawyer to be accomplished.

The purpose of universal coverage of lawyers participating in cases by appointment was to mobilize knowledge regarding the basic rules and nuances of advocacy in the segment of obligations subsidized by budgetary allocations, ensuring the safety of lawyers from unfounded claims from clients and law enforcement officers.

The speaker of the training series - President of the PASO T.D. Butovchenko, based on the norms of the current legislation, existing law enforcement acts on this issue, analysis of her own disciplinary practice and the experience of other regional chambers, provided the most relevant recommendations on the problematic topic, and also gave detailed answers to numerous questions from listeners.

The leitmotif was that any attempts to artificially, in the absence of grounds provided by law, inflate the cost of legal assistance provided by lawyers are unacceptable. The following were named as unacceptable: drafting and filing petitions and applications that are not intended to protect the interests of the client, unjustified performance of procedural actions by lawyers on weekends and holidays /or at night/ with subsequent presentation of a demand for payment at a qualified (increased) rate, etc.

At the in-person seminar held on December 6 in the PASO conference hall, Tatyana Dmitrievna also reported on the results of the completed inspection of the execution by lawyers of the Decision of the PASO Council No. 14-11-08/SP dated November 27, 2014 in the Kuibyshevsky and Sovetsky districts of the urban district of Samara, in the Komsomolsky district of the urban district of Tolyatti, in the urban district of Novokuibyshevsk, in the Kamyshlinsky and Klyavlinsky districts of the Samara region. The lawyers were informed that the comments of the inspectors mainly concern the maintenance of the questionnaire by the defense attorneys and the fulfillment of the requirements of Art. 13 of the Code of Professional Ethics of a Lawyer, paragraph 9 and paragraph 16 of the Standard for the Implementation of Defense by a Lawyer in Criminal Proceedings in Part of Appealing Interim and Final Judicial Acts, Other Decisions Violating the Rights and Legitimate Interests of the Defendant. The results of the audit, including an invitation to receive the provided dossiers, will be sent to each lawyer whose activities were audited within a working week to their personal email address in the InternetP@SO system.

The lawyers who participated in the webinars and the seminar absorbed the information received, catching the smallest nuances, and asked questions related to work in cases by appointment: interaction with investigative and judicial authorities, payment for lawyer work, joining a case when a lawyer evades or is unable to participate in a case by agreement, the procedure for replacing defenders, etc.

We hope that the series of training events was not only informative, but also maximally useful for lawyers of the Samara Region.
