248 delegates to the annual bar forum approved the reports on the work of the PASO Council and the results of the financial and economic audit for 2024, the income and expense budget for 2025, including the amount of mandatory deductions, and elected a member of the Audit Commission. They presented well-deserved awards to 120 colleagues. They compared their chosen course with the vision of the Ministry of Justice of the Russian Federation. They happily chatted in the corridors and participated in a corporate photo shoot.

May 21, 2025. Conference hall with the symbolic name "Peace." 11:00 AM. Tatyana Butovchenko, President of the Samara Region Bar Association, opened the 25th annual conference. The hall was filled with 248 elected delegates and distinguished guests.

From the Ministry of Justice's Perspective

Alexey Nikolaevich Sizov addressed the lawyers with a welcoming address:

Dear Tatyana Dmitrievna! Dear conference participants!
In 2024, the Federal Law on Advocacy and the Bar in the Russian Federation introduced significant changes, unlike previous years. The Unified State Register of Lawyers was created, and the status of the Integrated Information System of the Russian Bar Association (ISIS AR) was legally established. This will further facilitate electronic interaction between justice agencies, the Federal Chamber of Lawyers, and regional bar associations. Currently, the testing stage of the qualification exam is conducted entirely within the ISIS AR. This ensures a transparent, understandable, and convenient examination process. More than 70% of Russian regions have transitioned to the system for automatically distributing applications for appointed lawyers in court proceedings. To ensure the smooth operation of the CIS AR in implementing this capability, the Administration and the Chamber of Advocates of the Samara Region held a meeting with representatives of the judicial community and law enforcement agencies to discuss the need for the rapid implementation of the CIS AR in the region. Unfortunately, progress in this area is not progressing quickly enough. The Administration has organized and implemented a series of measures to provide the PASO with the necessary information to compile a directory of bodies authorized to request the appointment of defense counsel. This work will continue.

The legislative changes also affected the educational requirements for applicants to become attorneys. Individuals educated under the Bologna Process can now apply for attorney status with both a bachelor's and a master's degree. Thus, in 2024, 82 individuals applied for attorney status. A total of 73 attorneys passed the qualification exam and became PASO members. Fifty-seven attorneys terminated their status, most of whom voluntarily. The Samara Region remains the largest in the Volga Federal District for the number of active lawyers.

A representative of the Russian Ministry of Justice reported on the work to update the Samara Region's lawyer registry, including the replacement of previously issued lawyer licenses that have expired after 15 years. A total of 576 licenses need to be replaced; 304 have already been replaced, leaving 272 remaining. This work does not preclude lawyers from applying to the License Replacement Office at any time.

Over the course of its work, the Samara Region Office of the Ministry of Justice of the Russian Federation and the Samara Region Chamber of Advocates have developed constructive relationships based on the principles of business partnership, trust, and mutual respect. The participation of the Office's representatives in the work of the Qualification Commission is proof of this. Last year, the Qualification Commission, with the participation of the Office's representatives, reviewed 60 disciplinary proceedings, and in 43 cases, the commission concluded that the lawyers' actions violated the law or the Code of Professional Ethics for Advocates. The Office issued four notices to terminate the lawyer's status based on information received regarding the death of two lawyers, as well as the entry into force of sentences against two lawyers. All four lawyers have had their status terminated. The Office also issued two notices to impose disciplinary measures against the lawyers, resulting in a reprimand for one lawyer and a warning for the other. The basis for the submission was the lawyer's inappropriate behavior, including insults, including in correspondence, failure to appear for investigative actions without good reason, and refusal to sign investigative reports. The Department received complaints regarding threats by the lawyer, pressure, acquisition of the client's property, and the formal provision of legal assistance. These allegations have not been confirmed. However, it is worth noting that the Department has received information regarding the practice of law by, in particular, lawyers whose status has been suspended. This is unacceptable, except in isolated cases. Therefore, active engagement with the judicial community on this issue will be conducted this year.

The speaker drew the attention of human rights activists to new legislative requirements. For example, the Decree of the President of the Russian Federation of May 20, 2024, approved the Regulation on the procedure for preliminary notification of the FSB of the Russian Federation and the Foreign Intelligence Service of the Russian Federation by certain categories of individuals regarding their departure from the Russian Federation. In particular, the document stipulates that lawyers in possession of particularly sensitive or top secret information who plan to leave the Russian Federation must inform the FSB and SVR of this by sending a written notice to the territorial office of the Ministry of Justice. I ask that lawyers aware of particularly sensitive or top secret information take into account the provisions of the Ministry of Justice order of February 18, 2025, when notifying of their departure from Russia. Furthermore, starting in 2025, territorial justice authorities have been empowered to temporarily restrict the right of lawyers participating in legal proceedings involving information constituting a state secret to leave the Russian Federation. The restriction period is up to five years.

A.N. Sizov reminded the heads of law firms of the need to submit a report to the Ministry of Justice Office directly by mail or by posting it on the Ministry of Justice website. "Non-profit organizations are required to submit a report once a year by April 15." As of today, 35 law firms have not submitted their reports. I would also like to remind you that fees for providing legal services to foreign citizens and legal entities constitute foreign funding and are necessarily taken into account when preparing reports.

The speaker addressed the issue of consolidating lawyers within the legal profession. This issue was discussed at the St. Petersburg International Legal Forum and at the Federation Council and the Federal Chamber of Lawyers. On February 17, 2025, the Russian Ministry of Justice held a meeting with the heads of regional bar associations. At the meeting, the Minister of Justice noted that the legal profession is the optimal platform for uniting professional lawyers who defend citizens' interests in court, as it has an established infrastructure, a well-established set of ethical norms and professional standards, and established practices for their application. The Russian Ministry of Justice and the Federal Chamber of Lawyers have already developed specific regulatory proposals and submitted them to the Russian Government. It is expected that, as a general rule, representation in court will be provided primarily by lawyers. The consolidation of the legal profession will be implemented in several stages. The transition period following the law's entry into force will ensure a gradual transition of lawyers into the bar.

The main theme of the report (and the defining trend of the time) was information technology. This is a priority area for the Samara Region Bar Association, in which the PASO has been succeeding for many years. To support this thesis, the speaker cited impressive figures and facts.

"The Samara Region Bar Association always keeps pace with the times, sometimes even ahead of them. This is confirmed by our Subsidized Legal Aid Center, established in 2008, which in 2014 transitioned to full-scale automated assignment of claims. Now, practically in real time, building on accumulated experience, the Center is successfully transforming and integrating into the Integrated Information System of the Russian Bar Association (IIS AR).

We were ahead of the legal community by launching our own mobile app, which has faithfully supported information exchange between the Bar Association and lawyers for over three years.

Here are the key performance indicators for the app in 2024!

During the reporting period, 2,995 requests were received through the mobile app. This demonstrates the high demand for the app among lawyers.

The average processing time for one request is 45 minutes. The number of rejected requests is 171, which is approximately 6% of the total number of requests received.

The reasons for rejection are standard: incorrectly completed applications, duplicate requests, or insufficient information for review.

94% of the total number of requests received were processed. This demonstrates the app's effectiveness and meets user needs in most cases.

What awaits the app with the launch of the AR CIS?

Gradually, as the AR CIS information subsystems (electronic document management, financial block, etc.) are put into operation, the functionality of our app will be deactivated. The app has served us well for a long time.

The Chamber's mandatory presence on social media has become a trend of the times.

The PASO Telegram channel has been in operation for over three years and is an effective communication tool, stable, and constantly evolving. The channel's content is relevant and interesting to subscribers, as evidenced by its high engagement rate, and the steady subscriber growth attests to a successful channel development strategy.

Let's look at key metrics.

938 subscribers. On average, more than 20 subscribers are added each month. The average post reach is 1,097 users. This reach exceeds the number of subscribers, indicating that posts are shared and organic audience growth is driven by dissemination beyond the channel.

The frequency of posts indicates active channel management and regular content delivery. On average, about 20 posts are posted per month. 61% of users read posts within the first 24 hours.

But such total computerization has led to the emergence of cyber fraud! Information security is becoming a priority. We keep our finger on the pulse and warn or promptly notify of fraudulent attacks.

In 2024, the PASO website demonstrated stable operation and high user demand. This is evidenced by traffic figures and ratings.

Receiving the "Best Bar Association Website" award is a significant achievement and confirms the high quality of the PASO website, its information content, ease of use, and compliance with professional community requirements. This award is a testament to the successful work of the team responsible for maintaining and developing the website. In this regard, I would like to highlight the high professionalism of PASO Presidential Assistant Rumiya Abdryakhimova.

Our corporate email, InternetPASO, is also operational and has served us since 2008, and the relocation of our email service in 2023 did not disrupt the system.

Speaking about improving the professional level of lawyers, the PASO President reminded colleagues of the crucial day, May 31, when lawyers' compliance with the Professional Development Standard is reviewed throughout the year.

The President warned against disciplinary proceedings. Lawyers have access to a variety of in-person and remote training options, mostly free.

The PASO webinar platform has proven its worth. In 2024, 12 free training webinars were held for lawyers and trainees, totaling 60 training hours with a total of 2,359 participants. Lawyers actively participate in programs that interest them, including blitz webinars where they have the opportunity to ask and receive answers to pressing questions. The President urged those who are pre-booking the required minimum hours to not ignore the PASO and FPA RF webinars – they contain a wealth of useful and valuable information.

Fourteen in-person seminars were held in Samara, Tolyatti, and Syzran on topics related to professional practice, as well as on topics related to organizing legal practice that are difficult to understand but essential for everyone.

Lawyers actively participate in legal education for schoolchildren and students (non-legal majors).

Many lawyers participate in educational projects and provide legal assistance to children through public organizations.

In 2024, the staff of the Samara Region Bar Association won the "Lawyer of the Year in the Samara Region" award in the "Legal Education" category.

Through the School for Young Lawyers, we are building a talent pool for the Samara bar from law students and trainee lawyers. Graduates of the School are distinguished by their understanding of the principles of the profession and, by expanding the registry, strengthen the legal community. In 2024, the PASO School for Young Lawyers celebrated its 10th anniversary of nurturing young lawyers. Graduates of the School successfully pass the qualifying exam to become lawyers. The School is led by Tatyana Dmitrievna Ivanova and Vera Ivanovna Yankina.

At the end of 2024, the Unified State Register of Lawyers of the Russian Federation included 1,888 lawyers in the Samara Region, 164 of whom had their status suspended, leaving 1,724 lawyers with active status. Today, the active legal community of the Samara Region includes 1,723 lawyers.

Changes to the register occur at a standard pace, without any deviations. The registry is replenished by applicants who successfully passed the qualification exam; there will be 70 of them in 2024. Regarding withdrawals from the registry, based on personal requests,

- 49 lawyers' statuses were terminated,

- 16 lawyers transferred to other regional bar associations,

- 8 lawyers' statuses were terminated due to death:

The audience observed a moment of silence in memory of their colleagues. - Three lawyers' legal status was terminated due to the entry into force of court verdicts finding them guilty of intentional crimes (Part 2 of Article 159 of the Russian Criminal Code; Part 3 of Article 30; Part 4 of Article 159 of the Russian Criminal Code; Part 1 of Article 264.1 of the Russian Criminal Code; Part 3 of Article 30; Part 1 of Article 159 of the Criminal Code of the Russian Federation).

Four lawyers were subject to disciplinary action in the form of legal status termination.

The total number of disciplinary proceedings has decreased by nearly half, demonstrating a general improvement in the quality of legal assistance provided by lawyers and a more humane approach to disciplinary practice.

During the reporting period, 100 complaints/representations/appeals resulted in disciplinary proceedings, 31 of which resulted in disciplinary sanctions. In 120 cases, disciplinary proceedings were dismissed for various reasons. The introduction of the warning system contributed to a mitigation of disciplinary practices. In 2024, 24 warnings were issued to lawyers.

So, for what professional violations were the four lawyers' statuses terminated in 2024?

In two cases, this was a natural consequence of losing contact with the Bar Association and the legal profession, and failure to pay membership fees for both the general needs of the Bar Association and the upkeep of the Bar Association.

In the third case, the termination of the lawyer's status resulted from a colleague's failure to heed disciplinary warnings. The lawyer developed a personal rule against using inappropriate language in correspondence with law enforcement officials. The lawyer was given a disciplinary warning about the unacceptability of such behavior and the need to maintain a professional manner, but for some reason, he failed to take steps to correct his behavior. A further report from the head of the investigative body prompted the vice president to file a motion against the lawyer. The Qualifications Commission once again found that the lawyer had used vulgar and obscene language in the motions filed in the case, as well as in his correspondence with the investigator via instant messaging. The Council deemed the lawyer's behavior incompatible with the rules of the legal profession.

In the fourth case, a complaint was filed by a client against a court-appointed lawyer. Despite the presence of a court-appointed lawyer, the investigator requested the appointment of a lawyer while fulfilling the requirements of Article 217 of the Criminal Procedure Code of the Russian Federation. The defense attorney, who accepted the request, failed to visit the client, who was being held in a pretrial detention facility, provided no consultations, and signed the report "acting in the interests of the investigation" without actually reviewing the criminal case materials. The Qualification Commission found that, according to the schedule, the lawyer who had just accepted the case allegedly reviewed 126 volumes in one day, without submitting any motions or comments regarding procedural violations. Clearly, by signing the review schedule at the investigator's request, he merely facilitated the investigator's hasty referral of the criminal case to court and, in doing so, grossly violated his client's right to defense, acting contrary to his interests. Despite his limited legal experience, the lawyer's personal file contained information about previous disciplinary proceedings against him, and, even earlier, about his extensive service in law enforcement.

Two similar cases of "interaction" between the lawyer and investigative agencies were recorded in 2025. They also resulted in the lawyer's disbarment. In all cases, these lawyers joined the corporation from law enforcement.

T.D. Butovchenko noted:

"At last year's conference, I reported to delegates on the results of a survey regarding the admission of former investigators and inquiries to appointed positions. The PASO Council's initiative was not supported by lawyers. However, every instance of betrayal of a client's interests, as determined by the Qualification Commission, inevitably entails the maximum disciplinary penalty."

In her report, the PASO President focused on the transition to the Integrated Information System of the Russian Bar Association (IIS AR).

- Our established IIS AR Center, which has been operating since 2008, is awaiting major transformation.

In 2024, over 41,000 requests were distributed, including from the State Legal Bureau, 42,180 orders were issued, and a schedule of 3,092 lawyer visits to clients held in Pre-trial Detention Facility No. 1 was implemented. The call center recorded 81,592 incoming and outgoing calls.

The IIS AR Center will continue to operate in a new format. Starting June 1, the Center will assume the functions of IIS AR Operators, distributing requests received from the State Legal Bureau and scheduling lawyer visits to clients held in Pre-trial Detention Facility No. 1. Work is currently underway to restore Friday visits by lawyers to pre-trial detention facilities under the agreement.

In April 2024, amendments were made to the Federal Law regarding the transition of the Russian Bar Association to the Integrated Information System. In October 2024, the Federal Chamber of the Russian Federation adopted a resolution to implement the Integrated Information System AR in all constituent entities of the Russian Federation by October 1, 2025.

I should point out right away that there were no particular concerns about this; the Samara Region's legal community was prepared for the transition, both morally and technically. We took our time with the implementation of the Integrated Information System AR, received timely user training, constantly monitored the development and implementation stages of the system, compared the content and functionality of the Samara and federal systems, and thereby weathered the rough patches of the initial large-scale rollout.

During the initial phase, law enforcement officials received calls and written complaints about the lack of technical capacity to implement the system. The denial stage...

In early 2025, following a meeting held by the Russian Ministry of Justice, the inquiry, investigation, and courts came to the realization that changes were inevitable!

The acceptance stage had begun.

On April 2, activities related to the transition to the new system began:

New Rules for the Provision of Subsidized Legal Aid (PASO) were adopted,
graphic user guides were developed,
a new tab—KIS AR—was opened and is being populated with information on the official PASO website,
mass registration of lawyers and authorized bodies in the KIS AR is currently underway (over 1,200 users already),

Starting June 1, 2025, that is, literally in a week, the distribution of assignments for legal defense in the Samara Region will be carried out exclusively through the Integrated Information System of the Bar of Russia.

The President of the PASO thanked Pavel Viktorovich Sokol, Head of the Ministry of Justice of the Russian Federation for the Samara Region, for his active support of the information system implementation process and his talented organizational work with law enforcement officials in the region. Thanks to the administrative and personal efforts of the head of the Ministry of Justice, the stage of denial and resistance from authorized bodies—current users of the system—has been successfully overcome.

Elena Salnikova made a significant contribution, both in her work and intellectually, to the implementation of the system.

With the introduction of the new AR CIS subsystems, the registration and inclusion of all lawyers in the region in the integrated information system will become mandatory.

In conclusion, Tatyana Dmitrievna reported that the discussion of the "monopoly" of the legal profession has entered an active phase:

- On February 17, 2025, the Ministry of Justice of the Russian Federation held a meeting dedicated to the professionalization of legal representation.

On April 17, 2025, an extended meeting of the Council of the Federal Chamber of Lawyers of the Russian Federation was devoted to this topic, expressing support for the proposed professionalization of legal representation. The Ministry of Justice sent a corresponding instruction to the Russian government. The history of the Russian Bar is unfolding before our eyes.

Then, the delegates listened attentively to a report by Z.V. Baybulatova, Chair of the Audit Commission, on the Chamber's financial and economic performance during the reporting period. The report was approved unanimously (one lawyer abstained).

Due to the passing of Raisa Ivanovna Milevskaya, a member of the Audit Commission, the conference voted to elect Andrei Valerievich Borisov (Lawyer's Office No. 805, Tolyatti) to the commission with a term of office until May 2026.

There were no objections to the fourth agenda item—approval of the budget for the maintenance of the Samara Region Bar Association for the period from January 1 to December 31, 2025, including determining the amount of mandatory deductions for the general needs of the Samara Region Bar Association.

The conference adopted the following resolutions:

To approve the reports of the Council and the Audit Commission, including the implementation of the budget for the maintenance of the Samara Region Bar Association for the period from January 1 to December 31, 2024.
To approve the budget for the maintenance of the Samara Region Bar Association for the period from January 1, 2025 to December 31, 2025.
If the revenue portion of the budget is exceeded, the excess amounts shall be used for the maintenance of the Samara Region Bar Association and its statutory activities in accordance with the budget expenditure lines. To establish, effective January 1, 2025, mandatory monthly contributions from each lawyer for the general needs of the Chamber of Advocates of the Samara Region (excluding contributions for the first month of membership in the Chamber of Advocates of the Samara Region), including the maintenance of the Federal Chamber of Advocates of the Russian Federation, in the amount of 2,100 (two thousand one hundred) rubles.
To establish, effective May 1, 2025, mandatory monthly contributions from each lawyer for the general needs of the Chamber of Advocates of the Samara Region (excluding contributions for the first month of membership in the Chamber of Advocates of the Samara Region), including the maintenance of the Federal Chamber of Advocates of the Russian Federation, in the amount of 2,300 (two thousand three hundred) rubles.
To change the amount of mandatory monthly contributions from each lawyer for the general needs of the Chamber of Advocates of the Samara Region (except for contributions for the first month of membership in the Chamber of Advocates of the Samara Region) by the amount of the change in the amount of contributions for the general needs of the Federal Chamber of Advocates of the Russian Federation, if such a decision is adopted by the next All-Russian Congress of Advocates.
To determine the amount of mandatory contributions for the first month of membership in the Chamber of Advocates of the Samara Region for the general needs of the Chamber of Advocates of the Samara Region at 10 times the subsistence minimum in the Samara Region, established by the Government of the Samara Region for the working-age population, in effect at the time of making the mandatory contributions.
