PASO Council meeting

08/29/2024, the PASO Council meeting was held offline, switching to the autumn meeting mode.

The issues on the agenda were considered.

The status of two lawyers was resumed based on personal requests, on the basis of paragraph 5 of Article 16 of the Federal Law "On Advocacy and the Bar in the Russian Federation".

The status of one lawyer was suspended due to the inability to perform his professional duties for more than six months, in accordance with paragraph 2 of paragraph 1 of Article 16 of the Federal Law "On Advocacy and the Bar in the Russian Federation", the basis was the personal request of the lawyer.

The status of a lawyer was terminated based on paragraph 1 of paragraph 1 of Article 17 of the Federal Law "On Advocacy and the Bar in the Russian Federation" - a personal request of the lawyer.

The status of Dmitry Yuryevich Burkhanov was terminated due to death.

The PASO Council expresses its sincere condolences to his family and friends.

The PASO Council received four applications to change membership in the PASO in accordance with paragraph 5 of Article 15 of the Federal Law "On Advocacy and the Bar in the Russian Federation". In turn, the PASO Council will notify the territorial justice authority of the said decisions of the lawyers.

A disciplinary sanction was lifted early against one lawyer based on a personal appeal.

The PASO Council satisfied the applications: on inclusion in the system of providing subsidized legal aid - twenty-two lawyers; on the implementation of the Standard of professional training and professional development - one. Information was entered into the register of advocacy entities - two lawyer offices and one branch of the collegium were established, four lawyer offices were liquidated.

Ten disciplinary proceedings were considered.

The PASO Council made a decision to terminate two disciplinary proceedings based on complaints from clients against lawyers, due to the absence of violations of the norms of the legislation on advocacy and the bar and the norms of the Code of Professional Ethics of a Lawyer in the actions of lawyers.

At the suggestion of the Vice President of PASO, four disciplinary proceedings were initiated against lawyers who failed to comply with the advanced training standard. One of the lawyers had corrected the situation by the time of the Council meeting, and a reprimand was imposed as a disciplinary measure. The rest were given until 01.11.2024 to comply, otherwise the issue of terminating the status of a lawyer will be decided.

The number of appeals from judges due to the failure of defense attorneys to appear at court hearings without good reason is increasing.

Three disciplinary proceedings were considered based on complaints from judges from the Radishchensky and Zheleznodorozhny District Courts of Ulyanovsk and the Samara Regional Court. Disciplinary measures in the form of reprimands were imposed on two of them, and a warning about termination of status was issued on the third.

In this regard, the PASO Council prepared an Explanation on the issue of compliance by lawyers with the requirements of federal legislation and the Code of Professional Ethics of a Lawyer when participating in criminal proceedings as a defense attorney.
