Meeting of the Qualification Commission

On May 15, 2025, a regular meeting of the Qualification Commission of the Samara Region Bar Association was held.
The meeting's agenda included consideration of two disciplinary proceedings initiated based on complaints from clients, as well as the administration of the attorney qualification exam for 20 applicants who successfully passed the computerized test.
All proceedings were reviewed on their merits. In one case, the Commission concluded that the disciplinary proceedings should be terminated due to the absence of violations in the attorney's actions, while in the second case, violations were found in the attorney's actions.

The complaint against attorney S. alleged that the applicant had not received adequate qualified legal assistance. Due to the attorney's failure to properly complete the questionnaire, an assessment of the quality and scope of the attorney's work on the case was conducted during the disciplinary proceedings. The attorney was asked to provide explanations, materials from the attorney's case, copies of procedural documents, complaints, and motions. As a result of the trial, the arguments in the complaint were found to be unfounded.

The complaint against attorney B. stated that the attorney, who represented the applicant in the criminal proceedings by appointment, failed to file a motion to include video recordings and medical records in the case file when a more severe sentence was substituted for correctional labor. After reviewing the court record, he filed a request for payment for his services, but did not file an appeal against the court's ruling. The applicant's request for reinstatement of the missed deadline for filing an appeal was denied.
Attorney B. submitted explanations, enclosing copies of documents supporting his arguments, which do not refute the applicant's arguments regarding his failure to file an appeal against the court's ruling. The attorney did not issue a written waiver of his request to file an appeal.
Having assessed the disciplinary proceedings in their entirety, the Commission found violations of the law on advocacy and the legal profession, as well as the Standard for Defense in Criminal Proceedings adopted by the VIII All-Russian Congress of Advocates, in both form and content. ******
The Commission's findings have been included in the agenda of the meeting of the Council of the Chamber of Advocates of the Samara Region, which will take place on May 19, 2025.

After reviewing the disciplinary proceedings, the Commission began administering the qualification exam for attorney status, with eighteen applicants successfully passing.
Administering the exam is a challenging task, requiring Commission members to possess not only extensive theoretical and practical preparation, experience, and knowledge, but also a sense of humor and goodwill.
Here are a few stories I've heard from members of bar association qualification commissions:
- "Provocateur": "We encountered a candidate who was very self-assured. He began arguing with the commission on every question, proving his case. And he was often wrong! But he did it so assertively, with such aplomb, that some commission members even began to doubt their own rightness. He passed the exam, but it left a bad taste in his mouth..."
- "Stress Error": "One candidate had excellent theoretical preparation, spoke competently and confidently. But! He put the stress incorrectly on every other word. "dOgovor" instead of "dogovOr," "khodateAystvo" instead of "khodateAystvo." This, of course, isn't a crime, but it left a very strange impression. He was reprimanded, he corrected himself, but the commission harped on it for a long time afterwards."
- "Academics vs. Practitioners": "This one seems to know the theory inside and out. But I'm afraid his clients will run away from him in five minutes. Things don't happen in real life, the way he talks. He should spend a couple of years in court, gain some real-world experience." - This is usually said by experienced lawyers who are skeptical of law school graduates with no experience.
- "Repetition is the mother of learning": "He's certainly well prepared... But it feels like he's reading the text right in front of him. He gets confused on every other question, if you stray even slightly from what he's learned. Law isn't dogma; you need to be able to think!" - This is someone who gets indignant when they see rote memorization without understanding the essence.
- "Creativity is off the charts": "This young man certainly has imagination. When asked about fraud, he started telling a story about stealing the moon from the sky! Interesting, but completely off-topic. He'd be better off becoming a writer than a lawyer." - Sometimes the candidates' creativity goes beyond reason.
- "The client is always right, but...": "I understand him, of course, he wants to help everyone. But when he starts telling you how he'll deceive the court to win his client's case... That's too much. A lawyer must be honest, first and foremost, before the law." - Ethics is the cornerstone of the profession, and the commission strictly monitors this.
- "He's got a great sense of humor": "This guy is a rock! He answered a difficult question so wittily that even I laughed. It's clear he's a man of character who won't break under pressure. There's a shortage of people like him in the legal profession." - The commission evaluates not only the candidate's knowledge but also their personal qualities.
The above demonstrates that all commission members are committed to ensuring that only worthy colleagues, ready to honestly and professionally defend the rights of their clients, join the legal profession!
