CC PASO meeting 01/21/2021

21.01.2021 A regular (first in the New Year) meeting of the Qualification Commission of the Chamber of Lawyers of the Samara Region took place.

The commission considered fifteen disciplinary proceedings, two of which were initiated at the request of the court, three at the request of the Directorate of the Ministry of Justice of the Russian Federation in the Samara region, six at the suggestion of the Vice-President of PASO, four at the complaints of the principals.

Based on the results of consideration by the Commission:
- two disciplinary proceedings were terminated due to the withdrawal of the complaint by the complainant and the appeal of the court;
- six disciplinary proceedings were terminated due to the absence in the actions (inaction) of lawyers of violation of the legislation on advocacy and the legal profession and (or) the Code of Professional Ethics of a lawyer, or due to the proper performance by lawyers of their duties to the client or the chamber of lawyers;
- in six cases of disciplinary proceedings, violations of the legislation on the Bar and the Code of Professional Ethics of a Lawyer were found;
- one disciplinary proceeding was postponed for reasons recognized by the Commission as valid (the need to provide additional evidence).

The measure of disciplinary liability in relation to lawyers, in whose actions the Commission found violations of the legislation on the legal profession and the Code of Professional Ethics of a Lawyer, will be determined by the Council of the Chamber of Lawyers of the Samara Region at a meeting to be held on January 28, 2021.

The members of the commission approached the first meeting in the New Year with all responsibility, constructively discussed the tendencies arising in disciplinary practice, and were able to come to a common opinion on almost all disciplinary proceedings.
