Interaction of PASO with the Commissioner for Children's Rights in the Samara Region

On May 18, 2023, the Public Chamber of the Samara Region held a discussion of the annual report on the activities of the Commissioner for Children's Rights in the Samara Region in 2022.
On behalf of the President of the PASO, T.D. Butovchenko, the meeting was attended by Vice President of the PASO, Aleksey Borodin, and member of the qualification commission, Ksenia Shamanova.
The invitation of representatives of the Chamber of Advocates is not accidental, since lawyers have been cooperating with the Commissioner for a long time within the framework of the cooperation agreement. A number of joint events are reflected in the report.
The apparatus receives legal assistance on an ongoing basis from lawyer K.V. Shamanova, and lawyers Yu.V. Eremina, T.D. Ivanova, I.A. Zhdanov, E.A. Makhiyanova, and E.A. Verkhova are involved in joint projects.
In 2022, an agreement was reached to continue and develop cooperation between the Chamber of Advocates of the Samara Region and the Public Chamber, the Commissioner for Children's Rights, as well as orphanages of the Samara Region within the framework of legal education of pupils, mentoring projects and post-boarding support, orphanages and mentors from among lawyers were identified.
Acting Commissioner Marina Tarasova outlined the areas of joint work agreed with the PASO, which will be developed in the coming years.
First of all, this is the formation of a legal culture of pre-trial resolution of disputes concerning children, for which lawyers with the additional status of mediators can be involved.
Development of the mentoring direction with the involvement of an even larger number of lawyers, as well as cooperation within the framework of the Pro bono program.
And finally, the most pressing issue is cooperation in developing the practice of appointing courts in civil proceedings in disputes related to the upbringing of children (on determining which parent minor children will live with after the parents' divorce, determining the place of residence of children in the event of separate residence of parents and the procedure for exercising parental rights by a parent living separately from the child, on eliminating obstacles to communication with the child by his close relatives), and especially in cases related to the restriction or deprivation of parental rights, "taking away" a child in the event of an immediate threat to his life or health, in cases of reinstatement of parental rights, adoption and cancellation of adoption, establishing paternity, challenging paternity (maternity), forensic psychological or comprehensive forensic psychological and psychiatric examination, and not psychological examination.
The legal community supports the initiatives and proposals of the Commissioner for Children's Rights in the Samara Region, reflected in the report and aimed at improving the situation of children in the Samara Region.
