Samara hosts youth forum "The Future of the Bar"

On August 25, 2022, the Volga region forum of young lawyers continued its work. 112 delegates from 39 regional bar associations, as well as 150 lawyers from the Samara region and guests of honor gathered in the conference hall of the Ice Sports Palace of Samara.

The organizers of the forum - the Federal Chamber of Lawyers of the Russian Federation, the Chamber of Lawyers of the Samara Region and the Union of Young Lawyers of Russia - have designated the age limit for the participation of colleagues in the event: up to 40 years old, so that the most active representatives of the new generation of lawyers, who largely determine the future, show themselves corporations. Young lawyers were asked to discuss what each of them can bring to the legal profession, what they see as advocacy in the future, what should be changed to make the work of human rights defenders more efficient.

To make the discussion of key issues for the corporation more constructive, the organizers provided the forum participants with the opportunity to communicate informally with each other during the first two days of their stay in the Samara region, where the hospitable Chamber of Advocates (PASO) provided a variety of cultural and sports activities. Therefore, at the forum, representatives of the regions of the Russian Federation acted as a "united front", thinking and making decisions on a national scale.

REGULATIONS:
For participation in the first session of the forum, 35 competitive works from 33 bar associations were submitted. According to the results of the first stage of the competition, 12 finalists were selected, whose performances will be presented to the attention of the forum.
The theme of the speech is "The future of the legal profession: a youth view."
The format "PECHA-KUCHA" involves accompanying the performance with a presentation row. There are 20 slides in total, 20 seconds each.
The speaker does not control the change of slides. They are automatically flipped after 20 seconds. The total performance time is no more than 6 minutes 40 seconds.
The performance is evaluated both by a professional jury, which included 20 representatives of the bar associations of the Russian Federation, and by the audience present in the hall.

The jury evaluates the performance of each participant in the mobile application on a five-point scale in accordance with the specified criteria.
Spectators in the hall are given the opportunity to independently determine the favorite and award him with the Audience Choice Award (voting is carried out in a mobile application).

10:30 A series of short speeches was opened by the representative of the Voronezh Region Bar Association Yulia Shmygleva. From her point of view, the lawyer of the future is a member of the corporation, who is trusted by all civil society. After analyzing the current problems in the legal profession, Yulia named such ways to overcome them, as the introduction of a mandatory condition for obtaining (and further action) the status of a lawyer - awareness of the social function of the legal profession (helping those in need); more active participation of the bar in the formation of the regulatory framework, including the normative minimization of opportunities for interference in the internal affairs of the bar; introduction of a lawyer's monopoly on judicial protection and judicial representation, ensuring decent remuneration for the intended purpose (at the level of wages of opponents).

10:37 Aleksey Sozvariev, a representative of the Chamber of Lawyers of the Kaliningrad Region, urged the corporation to rebrand ("otherwise it will be more and more difficult to compete with large legal brands"), to revive and maintain the image of a lawyer as a socially oriented professional who readily provides legal assistance to socially vulnerable segments of the population, engaged in legal education throughout his career; establish certain limits for the content of lawyers in social networks, so that the image of each lawyer inspires respect and builds public confidence in the legal profession as a whole.

10:43 The third participant, Vartkes Chubaryan, a representative of the Chamber of Lawyers of the Rostov Region, drew the attention of colleagues to the trend towards total digitalization in all spheres of society, including legal ones.
With the widespread automation of processes, the active introduction of electronic assistants and legal robots, the increasing immersion of society into virtual reality, according to the speaker, a lawyer - a superhero of our time, a professional - should definitely not be afraid of new technologies and oppose progress, because "the lawyer will deal with his direct duties: to build a strategy for conducting a case, to assess the psychological characteristics of the principal and opponents, to determine the possibility of applying a particular rule of law.

10:52 Andrey Makarenkov, a lawyer from the Administration of the Omsk region, pinned his hopes for changes in the state legal system on the implementation of the Justice program and the Concept for regulating the professional legal aid market, aimed at ensuring that persons with appropriate qualifications will be allowed to provide legal assistance. The bar can become a platform for uniting lawyers, however, according to A. Makarenkov, the mechanism proposed by the Concept for simplified obtaining the status of a lawyer by private practicing lawyers requires some adjustment. The speaker noted that "a lawyer should acquire the status of a lawyer by vocation, and not by necessity." As for improving the quality of legal assistance provided by lawyers, A. Makarenkov believes that this will be facilitated by the creation of organizational and legal mechanisms for specialization in the legal profession.

10:59 Tatyana Bluzma (author of the essay - Tatyana Karasyova) presented the Chamber of Lawyers of the Penza Region. She expressed the opinion that the total use of artificial intelligence even after several decades without a professional community of lawyers is impossible and unacceptable, if only because the machine lacks a sense of justice inherent in a person and the ability to empathize with his client. For a new generation lawyer, the ability to identify the needs of a person and society faster and more accurately than other experts and to satisfy them as efficiently as possible comes to the fore. In this regard, it is necessary to master new tools. According to Penza colleagues, the lawyer of the future will not conduct cases, but manage their flows. Therefore, it is advisable for the bar to develop not instead of, but together with the development of digital and information technologies, to apply programs that allow processing large databases.

11:08 A participant from the Chamber of Lawyers of the Republic of Crimea, Alexander Kormilitsyn, said that the legal profession is currently continuing to develop, while changing the vector of its development towards high technologies. Using the example of a dispute between a robot and a lawyer conducted by testers, the speaker showed that the achievement of the most significant results in the field of law lies not in the competition between a person and a computer, but in their interaction. According to A. Kormilitsyn, both document constructors and bots act only as a useful tool, simplifying the first step in resolving the issue, but they do not have the level of expertise of a professional lawyer and cannot predetermine the outcome of the case, or the expediency of drawing up one or another legal document.

11:14 Lawyer of the Chamber of Advocates of the Samara Region, member of the PASO Council Artem Dyachenko, fully aware that the future of the bar is in his hands, introduced himself as the President of the Chamber of Lawyers. Positive changes in the legal profession, in his opinion, need to start with oneself, therefore, as a future leader, Artem Igorevich presented such requirements as responsibility, managerial skills, continuity, systematic training and professional development, progressiveness, mutual respect. Samara lawyers do not have to look far for an example, because in PASO everything is organized “God forbid everyone”, but future generations will also find what can be completed and improved, where to introduce new and replace obsolete ones. According to the speaker, young lawyers who will become presidents of the chambers should learn from the experience of the history of the formation of the independence of a lawyer corporation in Russia and harmoniously develop it in the future, without interruption following the established lawyer traditions.

11:22 Olga Pychkova, a representative of the Chamber of Advocates of the Perm Territory, focused the attention of the audience on such an important task for her region as the rejuvenation of the legal profession. According to O. Pychkova, the average age of a lawyer in the Perm Territory is 49.5 years, and only 1.9% of lawyers are under 30 years old. In this regard, the solution to the problem of attracting young lawyers to the profession, the speaker believes, should begin with universities, through the introduction of scholarship programs for future lawyers, providing an opportunity for student practice in law firms, and wider coverage of experienced lawyers in teaching activities. As an example of an idea successfully implemented in the territory of the region, O. Pychkova cited the legal educational project “Advocacy at School”. And for young lawyers who have already received the status, a good measure of support, in her opinion, is the preferential amount of membership fees.

11:29 Valeria Nesina, a representative of the Chamber of Lawyers of the Primorsky Territory, outlined her vision of the bar of the future as an institution of civil society that is actively developing and respected by the state and society.
According to the speaker, in order for society and the state to respect lawyers and trust them, it is necessary to impose strict requirements not only on professional qualities, but also on moral, ethical, ethical ones, excluding from the professional community lawyers who have betrayed the principles of advocacy for their own selfish goals.
In professional terms, V. Nesin connects the development of advocacy with a narrow specialization and the deepest immersion of each member of the corporation in his field of law. It is impossible, the speaker believes, to allow the emergence of multidisciplinary, incompetent lawyers, and in this regard, he proposes to divide lawyers into specializations, entering data into the appropriate register. And if a lawyer wants to receive additional specializations, then he needs to pass the appropriate exam.
“I would like to see professionals in their field, with high moral principles, in the advocacy,” concluded V. Nesina.

11:35 Lawyer from the Republic of Bashkiria Evgeny Gusev in his speech outlined the problems that accompany the current stage of digitalization and e-justice. In order for modern technologies to help, and not interfere with a lawyer in his work, and also taking another step towards a lawyer's monopoly, the author proposed creating a lawyer portal "Zakon" - a platform for citizens with a corresponding website on the Internet, as well as a mobile application. According to E. Gusev, such a portal will allow a lawyer to use common mechanisms for attracting principals, digitalize the full cycle of workflow when conducting a case in court from a lawyer’s personal account, remotely conclude electronic lawyer agreements, and automatically generate receipts for citizens to pay for legal assistance.

11:42 The series of short speeches was completed by the presentation of a lawyer from the Tambov Regional Administration Artem Vorobyov. According to him, the issue of the future of the Russian legal profession should be considered in the context of internal transformations, the introduction of the results of scientific and technological progress, a fundamental improvement in the quality of legal assistance and strengthening the degree of protection of the professional community. The development of the legal profession, according to A. Vorobyov, should go in the following directions:
• Strengthening the independence of the bar, including through tougher liability for violations of the rights of lawyers and obstruction of professional activities;
• systematic activation (reanimation) of the concept of a lawyer's monopoly;
• increasing the requirements for the quality of knowledge and the moral and ethical component of each applicant for the status of a lawyer, as well as acting lawyers;
• legal education of citizens;
• development of electronic document management, expansion at the legislative level of lawyers' opportunities to collect and process personal data.
At the same time, by carrying out transformations today, acting lawyers assume responsibility for what the legal profession will be like tomorrow.

RULES OF THE GAME:
"Brainstorm" is a business intellectual game for young lawyers. The goal is a deep understanding of the rules of the legal profession, the ability to quickly and correctly resolve the issues raised as part of a team.
The game includes 3 game rounds: 1st round "WARM-UP" - 5 questions, 2nd round "BLITZ" - 10 questions, 3rd round "LOGIC" - 3 questions. The team with the most points wins.

First round questions require increased speed of team discussion and decision making. 1 minute is allotted for discussion. The answer is announced only by one team, the first to raise a color card. The correctness of the answer is evaluated by the jury. If the answer is not counted, the chairman of the jury gives the correct answer. For each correct answer, the team receives 2 points.
To participate in the Blitz round, teams choose one representative each.
The first person to raise a colored card answers the question. The leader determines the correctness of the answer. If the answer is wrong, the right to answer passes to the next team; if the representative of the second team answers incorrectly, or none of the participants of the round raised the card within 20 seconds, the presenter himself voices the correct answer and proceeds to the next question. For each correct answer, the team is awarded 1 point.
The third round will allow each team to exercise cognitive flexibility in answering the question. 2 minutes are allotted for discussion. Each team responds in turn. The jury evaluates the answers on a five-point scale.
Tips from the audience are not allowed.

The lawyer succeeded in appealing against the guilty verdict, after which he went to the pharmacy, bought two cans of petroleum jelly, glued each of them to the bottom of two cardboard boxes, and mailed them to the trial judge and the public prosecutor. Reports about the lawyer's actions were received by the lawyers' chamber from the court and from the district prosecutor. How many disciplinary proceedings have been initiated against a lawyer and what is the procedure for initiating each of them?

Question 2. At the request of the victim, the lawyer filed a motion to conduct an investigative experiment, proposing to handcuff one of the law enforcers to the saddle of a horse, run it at a gallop, fix the injuries they received in order to compare them with the injuries received by the victim. The text of the petition contained the argument: "If one or two prosecutors or investigators die as a result of the experiment, this is a small loss for justice." What provisions of the law are violated by the lawyer?

Question 3. It follows from the appeal of the court in relation to the lawyer that he does not want to fulfill professional duties, acts contrary to the interests of the client, refusing to take measures to search for her in order to serve a notice of bringing an appeal.

Question 4. The lawyer posted on his personal page of the social network a poem containing obscene language against the mayor.

2:30 p.m. Round 3 begins.
In the third round, the teams were asked 3 questions. After a two-minute discussion, each team presented their answer.

Question 1: The Chamber of Lawyers received an appeal from the judge, from which it follows that the lawyer was asleep during the pronouncement of the indictment by the prosecutor, which showed obvious disrespect to the court and other participants in the process. Offer your version of the explanations sent by the lawyer to the qualification commission on this appeal.
Question 2: From the report of the head of the pre-trial detention center, it follows that the lawyer, while in the investigation office, posted a leaflet with political content on the wall. Formulate the grounds for bringing a lawyer to disciplinary liability with reference to the norms of the Lawyer's Code of Professional Ethics.
Question 3: Throughout the lengthy trial, the lawyer began each court session by challenging the presiding judge and filing multiple motions. The verdict was particularly severe in comparison with the established practice of sentencing in this category of cases. The Chamber of Lawyers received a complaint from the convict about the incorrect behavior of the defense counsel, which provoked the imposition of a harsh sentence. Is there a disciplinary offense in the actions of a lawyer? If so, what norm of the Lawyer's Code of Professional Ethics has been violated by the defender?
