Educational criminal process

On April 18, the PASO Young Lawyer's School hosted a business game "Educational Criminal Trial with Jury". Such training events with the participation of both trainees and young lawyers are a tradition of the School. The format of the business game allows participants to experience the peculiarities of working with a jury and practice the necessary skills of judicial rhetoric, persuasion, and conveying the essence of the circumstances of the case to citizens who are not familiar with jurisprudence. Previously, the training criminal trials of the Young Lawyer's School were held both in the PASO conference hall and in the real courtroom of the district court.

This time, in the year of the 20th anniversary of the PASO, the educational process was held in the courtroom of the Law Institute of the Samara National Research University. ak. A.P. Korolev, which most of the lawyers of the Samara region remember as the Kuibyshev branch of the VYUZI or the law faculty of the Samara State University - their Alma Mater.

The business game began with a parting word from PASO President Tatyana Dmitrievna Butovchenko, who shared with the participants her own experience of speaking in the educational process as a student and noted the importance of this form of advanced training for both students and interns and lawyers.

During the mock court session, a criminal case was considered, formed on the basis of a real indictment under Part 4 of Art. 111 of the Criminal Code of the Russian Federation (“intentional infliction of grievous bodily harm, negligently resulting in the death of the victim”). In reality, the criminal case ended in a guilty verdict and became widely known. Four comrades went to the taiga in search of gold, got lost, wandered for a long time. One of them went missing. And the other two, out of hunger, ate the third one. During the investigation and in court, both recognized this terrible fact. The jury in the educational process had to answer the question of the causes of death of the unfortunate - whether he died from cold, hunger, accidental injury or from a blow inflicted by the defendants.

In addition to the students of the Young Lawyer's School, lawyers V. V. Foefanov, D. S. Salishchev, R. R. Girfanov, as well as D. A. Taraborin, Vice-President of the PASO, who led the process as a judge, took part in the process.

The preparation of the business game took more than a month. During this time, master classes were held for the students of the School by lawyers with experience in working with jury trials, dedicated to the peculiarities of this form of legal proceedings. During the training, the interns gained new skills in the field of analyzing a criminal case, developing a position, preparing a lawyer together with a client to testify, etc.

All participants and spectators of the trial noted how difficult the task of the prosecution and defense was compared to working in a trial without a jury. It was not always possible to keep their attention and focus it on the main thing. However, the verdict "not guilty" was unanimous!

The Young Lawyer School will certainly continue to develop and improve such an effective form of training activities as conducting educational processes.
