On January 30, 2025, the Council of the Chamber of Advocates of the Samara Region held its regular meeting to discuss important issues related to the activities of the region's legal community. Regular meetings of the Chamber of Advocates of the Samara Region Council serve not only as a platform for decision-making but also as an opportunity to strengthen the organization in the challenging professional environment.

The Chamber of Advocates of the Samara Region Council welcomed two new members, who took the oath of office that day. The Chamber of Advocates of the Samara Region Council adopted a resolution to convene the Twenty-fifth (Regular) Annual Conference of Advocates of the Samara Region.
The conference will be held on May 21, 2025 (Wednesday).

Applications for inclusion in the subsidized legal aid system were granted for eight attorneys. Information was entered into the register of legal entities—three law offices and one law firm were approved. The legal status of six attorneys was suspended, two attorneys were reinstated, and two attorneys were terminated.
Attorney A.'s legal status was terminated due to the entry into force of a court verdict finding him guilty of committing a deliberate crime.
The PASO Council regrets to inform you of the termination of the legal status of attorneys Sergei Vladimirovich Rasskazov and Konstantin Viktorovich Zefirov, who died suddenly and due to a long illness.

Based on information from the PASO Center for Legal Advisers regarding systematic refusals to accept claims, ninety-nine lawyers have been removed from the List of Participants of the PASO.
In accordance with current legislation, the PASO Council reviewed the applications of lawyer K. and lawyer M. to change their membership in the Samara Region Bar Association to the Moscow City Bar Association.
Disciplinary Proceedings:
Thirteen disciplinary proceedings were reviewed:
Attorney K. was issued a notice of termination of his status. The lawyer missed the deadline to file an appeal against the ruling of the Justice of the Peace of Judicial District No. ***, resulting in a complaint filed on behalf of his client regarding the provision of substandard legal assistance.
Disciplinary proceedings were initiated against lawyer S. based on the client's complaint. The client alleged that the lawyer's services were forced upon him. The Qualification Commission determined that the claim was not distributed to attorney S., as the Center for Legal Advocacy had information that an agreement had been concluded with three defense attorneys for the case. Despite having defense attorneys under the agreement, attorney S. joined the case at the investigator's invitation. Attorney S. lacked legal grounds for joining the case, which is a violation of Article 25 of the Federal Law "On Advocacy and the Bar of the Russian Federation." Imposing legal services by assisting investigative bodies violates paragraph 1 of Article 8 of the Qualification Commission. Such actions are contrary to the law and the interests of the client. The Commission concluded that attorney S. was guided by considerations of self-interest or other immoral interests in committing these actions, which is a violation of Article 9 of the Qualification Commission. In connection with this, the PASO Council decided to terminate his status as an attorney, with the right to re-take the qualification exam to obtain the status of attorney after three years. Disciplinary proceedings against attorney Sh. were terminated due to reconciliation between the parties.
Disciplinary proceedings against attorney R. were terminated due to their insignificance.
Seven attorneys who failed to submit their legal files for review while participating in assigned cases were issued disciplinary action in the form of a reprimand.
Attorney R.'s status was terminated due to non-payment of membership dues, as well as loss of contact and lack of communication.
Disciplinary proceedings against attorney N. were terminated due to the payment of outstanding membership dues and the suspension of his status.
The PASO Council considers it relevant to remind attorneys that on January 29, 2015, Clarifications were issued regarding the issue of concluding an agreement to provide legal assistance to a third party.
On June 18, 2024, the Ethics and Standards Commission of the Federal Chamber of Lawyers of the Russian Federation issued a clarification on certain issues related to a lawyer's conclusion of an agreement to provide legal assistance to a person appointed by a party to the agreement.
Strict adherence to the above rules will prevent lawyers from having to verify their actions in disciplinary proceedings.
