The PASO Qualification Commission has begun its work

16.05.2024, the first meeting of the Qualification Commission of the Chamber of Advocates of the Samara Region in its new composition was held.
The agenda of the meeting included the election of the chairman of the Qualification Commission of the new composition, one disciplinary proceeding initiated by a court notice, as well as the administration of the qualification exam for assigning the status of a lawyer to applicants who successfully passed the computer testing (17 people).
The President of the PASO, T.D. Butovchenko, warmly welcomed those present, recalled the principles of the Commission's activities, the main one of which is the principle of the presumption of the good faith of a lawyer, and wished them successful work for the next two years, objectivity, honesty, integrity and a professional approach.

Reporting on the materials of the disciplinary proceedings, the chairman of the commission noted that for the first time in 22 years of the Qualification Commission's activity, one proceeding is on the agenda!
From the appeal of the judge of the Radishchevsky District Court of the Ulyanovsk Region in relation to lawyer P. it follows that the lawyer is defending the interests of A. in criminal proceedings with the participation of jurors by agreement, order No. from 03/18/2024.
On 03/18/2024, at the court hearing, the defendant A. confirmed to the court the fact of the agreement concluded with lawyer P., refused the assistance of a lawyer by appointment. In the court hearing on 03/18/2024, a break was announced until 10:00 on 03/19/2024.
Lawyer P., duly notified of the date, time and place of the hearing, failed to appear at the court hearing on 19.03.2024 at 10:00, having sent a petition to the court by e-mail to postpone the court hearing due to his being busy with another trial in the Kirovsky District Court of Samara, which contradicts the requirements of paragraph 1 of Article 14, paragraph 5 of paragraph 1 of Article 9, paragraph 3 of Article 10 of the Code of Professional Ethics of Lawyers.
The lawyer submitted explanations to the Commission expressing disagreement with the court's arguments.
The Commission found that the lawyer's actions constituted a disciplinary offense, expressed in his failure to appear at the court hearing, the date and time of which had been deliberately agreed upon by all participants in the process, in the absence of prior notice.
Having concluded that the lawyer violated Article 14 KPEA, the Commission pointed out the inadmissibility of such actions on the part of lawyers, since they undermine respect for the activities of a lawyer and the legal profession as a whole, discredit the lawyer as a participant in legal proceedings, and cause significant harm to the authority of the legal profession as an institution of civil society.

Sixteen applicants successfully passed the qualification exam and were invited to take the oath at a meeting of the Council of the Chamber of Advocates of the Samara Region, which will be held on 30.05.2024.
