PASO Council meeting

On April 28, a regular meeting of the Council of the Chamber of Advocates of the Samara Region took place.

PASO President T.D. Butovchenko informed the members of the Council about the preparations for the XXII Regular Annual Reporting and Election Conference of Lawyers, which will be held on May 26, 2022. In 2022, the Chamber of Advocates of the Samara Region is celebrating its twentieth anniversary, and the Samara Regional Bar Association will be celebrating its centenary! These dates give special solemnity to the forthcoming annual conference.

PASO President and members of the Council congratulated PASO Vice President Taraborin D.A. with the election of a Counselor of the Federal Chamber of Lawyers of the Russian Federation. T.D. Butovchenko wished him success in his new position at the federal level and expressed confidence that his activities would be useful both to the FPA and the Chamber of Advocates of the Samara Region.

The Council took an oath of allegiance to the lawyer's duty from three applicants who successfully passed the qualifying examination.

Then the PASO Council proceeded to work on the agenda. The Council granted the applications of two lawyers to terminate their membership in the PASO due to the change of the place of implementation of advocacy to another region. Three lawyers applied for suspension, one for renewal and three for termination. Six lawyers were credited with professional development hours. Based on the statements of the principals, gratitude was announced to five lawyers.

Thirteen lawyers were included in the subsidized legal aid by appointment system.

On the eve of the 20th anniversary of the PASO, the Council made a decision on the early removal of disciplinary sanctions against lawyers. A lawyer who has been sanctioned may apply to the Council for inclusion in the subsidized legal aid system. The next meeting of the PASO Council will be held on May 23, 2022.

The Council of the PASO decided to provide material assistance to lawyers-veterans of the Wars on the Victory Day, as well as veterans of the bar on the Day of the Russian Bar.

During the meeting of the Council, three disciplinary proceedings were considered.

One of them was initiated on the basis of a client's complaint about the quality of the work of lawyer S. in the case. The Qualification Commission found that lawyer S. never entered into an agreement with this principal, did not accept money from him, and did not provide legal assistance. The agreement with this client was concluded by his colleague, lawyer V., with whom they rent an office together. As a result of a technical error, V. printed out for the principal the text of the agreement with the data of her colleague and put her signature in it. She also received the fee and worked on the case. Under such circumstances, the PASO Council agreed with the conclusion of the Qualification Commission and terminated the disciplinary proceedings against lawyer S.

In another complaint, the principal indicated that in 2018 the lawyer defended his interests in a criminal case initiated under Part 4 of Art. 159 of the Criminal Code of the Russian Federation. After drawing up the agreement and receiving a fee for conducting the case, the lawyer entered into an interest-free loan agreement with the principal for one month in the amount of 1,300,000 rubles. So far, the debt has not been returned. During the meetings of the Council, the lawyer did not deny that he had committed a violation of clause 10 of the CEA, that is, he had placed himself in debt dependence on the principal. The parties were given a month to reconcile.

The third proceeding was initiated on the basis of a court report, from which it followed that at the hearing the lawyer did not share the position of the principal who wanted to confess, as he was convinced of the existence of self-incrimination. According to the court, the lawyer recused himself due to a divergence of positions with the principal, arbitrarily left the courtroom and did not answer the secretary's calls. However, the attached audio protocol did not contain such statements by the lawyer. In this regard, the Council terminated this disciplinary proceeding due to the absence of a violation in the lawyer's actions.

At the end of the meeting, members of the Council congratulated Yablokov V.A. on his birthday. and wished him success in advocacy and all other projects.
