Taking the oath.
Nineteen new attorneys took the oath at the Samara Region Bar Association.
The Qualification Committee noted the high level of preparation of the applicants, particularly singling out S.V. Boyko, O.E. Lobzinova, and I.G. Shevchenko for their knowledge and professional skills.
The President and Council of the Samara Region Bar Association congratulated their new colleagues, wishing them to honor the title of attorney, become outstanding representatives of the profession, and receive well-deserved recognition for their work. "May your efforts be duly appreciated, earning the respect of your clients and strengthening the prestige of the legal profession," emphasized T.D. Butovchenko, President of the Samara Region Bar Association.
Then the Council of the Samara Region Bar Association proceeded to consider the items on the agenda.
The Samara Region Bar Association Council adopted a number of decisions on matters of membership and the status of attorneys.
The Council of the Chamber of Advocates of the Samara Region approved the application of one attorney to change his membership in the PASO due to his transfer to the Moscow City Bar Association. The basis for this decision was Section 5, Article 15 of the Federal Law "On Advocacy and the Bar in the Russian Federation."
A decision was also made to suspend the status of three attorneys based on their personal applications in accordance with Section 5, Section 1, Article 16 of the Federal Law "On Advocacy and the Bar in the Russian Federation."
The status of two attorneys who had previously suspended their practice was reinstated in accordance with Section 5, Article 16 of the Federal Law "On Advocacy and the Bar in the Russian Federation."
The PASO Council reviewed applications for early removal of disciplinary action and denied two attorneys. One of them refused to provide his legal records for review, while the other systematically violated his clients' rights to defense while participating in criminal cases. For the same reason, they were denied inclusion in the subsidized legal aid system.
At the same time, nine lawyers were approved for inclusion in the Subsidized Legal Aid Center (SLA).
Furthermore, information on the creation of one law firm was added to the register of bar associations.
Disciplinary Proceedings.
Disciplinary proceedings against lawyer G. were terminated due to the insignificance of the violation.
Lawyer Z. avoided disciplinary action by reconciling with the complainant, which served as grounds for termination.
The PASO Council noted that the minimal number of disciplinary proceedings attests to the high professional discipline of lawyers, their commitment to upholding professional standards, and the effective protection of their clients' rights.
The PASO Council clarifies the requirement to present a passport along with a lawyer's identification card.
In response to inquiries from lawyers regarding the requirement to present a passport along with their lawyer's ID card, the Samara Regional Bar Association Council clarifies that this requirement is based on the provisions of Order No. 1 of the Russian Ministry of Internal Affairs.
A lawyer's ID card confirms a lawyer's status; however, in some cases, law enforcement officers also request a passport, the primary identification document. The Council recommends that colleagues take this requirement into account in their professional activities and, if any disputes arise, seek clarification from the Samara Regional Bar Association.
Restrictions on the right to travel abroad for lawyers with access to state secrets.
The Council of the Samara Regional Bar Association reminds that, in accordance with Federal Law No. 114-FZ "On the Procedure for Leaving the Russian Federation and Entering the Russian Federation," temporary restrictions on travel outside the country have been introduced for lawyers with access to information constituting a state secret.
This restriction is imposed for the duration of the state secret clearance and may remain in effect for up to five years after its expiration, if so provided in the lawyer's signed non-disclosure agreement.
The PASO Council recommends that lawyers who hold or are applying for state secret clearance consider possible restrictions when planning trips abroad and consult with the relevant authorities if questions arise.
