On May 27, 2021, the 21st (regular) annual conference of lawyers of the Samara region took place. For 1 hour and 50 minutes, the conference delegates managed to acknowledge the professional merits of 101 lawyers; approve the reports of the PASO Council, including on the execution of the estimate of income and expenses for the maintenance of the bar association in 2020, the report of the Audit Commission on the results of the audit of the financial and economic activities of the PASO over the past year; to accept the estimate of income and expenses of PASO for 2021, leaving the amount of membership fees unchanged.

Such prompt, clear, well-coordinated work of the conference is the result of tremendous organizational efforts undertaken by the activists of the Chamber of Advocates of the Samara Region since its inception, and evidence of the corporate unity of the Samara Bar, as well as a consequence of the impeccable execution of operational tasks by the PASO apparatus, which prepared working materials in advance and provided support for the event. ... 304 delegates were elected to work at the 21st conference by the bar associations. 226 delegates registered, thus exceeding the threshold for reaching a quorum (203 people). In accordance with the Decision of the PASO Council dated 05.24.2021, the Vice-President of PASO Alexey Viktorovich Borodin was elected as the chairperson of the 21st Annual Conference of Lawyers of the Samara Region.
Traditionally, representatives of the Samara Region Administration of the Ministry of Justice of the Russian Federation took part in the event: Pavel Viktorovich Sokol and Alena Genadievna Gevorkyan.

Opening the conference, the lawyers gathered in the Mir conference hall of the Renaissance hotel were greeted by the President of the Chamber of Lawyers of the Samara Region Tatyana Dmitrievna Butovchenko. She gave the floor to P.V. Falcon. He described the Samara Bar Association as “a fusion of youth and experience”, since the majority of PASO members have 15 years of experience; noted the leadership of PASO in terms of numerical strength (1729 active lawyers - according to information from 05/01/2021 - the first indicator in the Volga Federal District and the third in the country); noted with satisfaction that young people are actively joining the ranks of lawyers. Speaking about the interaction of the Bar and the Ministry of Justice, P.V. Sokol repeated the words of the Minister of Justice K.A. Chuichenko: "The development and improvement of the quality of advocacy is one of the priority tasks of our ministry, and the further development of the legal profession, its replenishment with qualified personnel and, ultimately, the strengthening of justice and legal protection depend on the effectiveness of this work, the correctness and balance of regulatory decisions."

Regarding the priority direction for the ministry in organizing free legal aid, P.V. Sokol reported on the upcoming legislative changes aimed at solving the tasks set by the President of the Russian Federation for opening a legal bureau in each municipal formation with the possibility of a lawyer participating in legal assistance in the most complex categories of cases. Once again, Pavel Viktorovich expressed the hope that the number of lawyers in the state legal aid system from three lawyers in the 2020 list will increase many times.

P.V. Sokol also announced plans to digitize advocacy in Russia, including the creation of an integrated information system "The Bar of Russia", the development of a project for a unified state portal of legal education and reform in terms of creating a unified state register of lawyers, which will be modernized. In this regard, P.V. Sokol stressed that PASO has advanced experience in the implementation of digital technologies, and the 14-year work of the Center for SUP PASO is an example for the whole country. “I am sure that you will continue to develop professionally, especially since the regional department of the Ministry of Justice is always open for joint constructive work,” he concluded.

After the election of the counting commission consisting of four people (Zoya Vyacheslavovna Baybulatova, Olga Nikolaevna Latyshkina, Elena Vladimirovna Muratshina, Dmitry Sergeevich Rakov), the establishment of the time limit for speeches and the approval of the agenda, including questions on the approval of the reports of the Council of the Chamber of Lawyers of the Samara Region, including the execution of the estimate income and expenses for the maintenance of the Bar Chamber, and the Audit Commission of the Chamber of Lawyers of the Samara Region on the results of the audit of the financial and economic activities of the PASO for the period from January 01, 2020 to December 31, 2020, estimates of income and expenses of the Chamber of Lawyers of the Samara Region for 2021 and by definition the amount of compulsory contributions for the general needs of the Chamber of Advocates of the Samara Region, the conference delegates began their work.

Tatyana Dmitrievna noted that the Chamber of Lawyers of the Samara Region honorably accepted the challenges of the pandemic 2020: “Consistently introducing the latest IT developments, we were ready for remote work, and for electronic document management, and for the effective use of modern communication channels. The Center for Subsidized Legal Aid (SJA) allowed not only not to stop human rights activities, not to suspend them for a minute, but also to maintain the same volume of free legal aid, even during the period of the most severe restrictions imposed to combat COVID-19. The electronic Procedure for visiting by lawyers of clients held in FKU SIZO-1 of the Federal Penitentiary Service of Russia in the Samara Region, adopted by the PASO Council, continued to operate. The Internet PASO system has been successfully tested by the pandemic. The PASO website has been updated.

The lawyers worked by switching to a remote mode. During the reporting period, in addition to face-to-face meetings of the PASO Council, 22 meetings were also held in zoom-conference mode. The PASO Council immediately, on a daily basis, considered applications for the suspension of the status of a lawyer in connection with the decision on self-isolation. " Tatyana Dmitrievna thanked the Department of the Ministry of Justice in the Samara region for promptly making changes to the register on the suspension of the status in such cases and the implementation of the agreements reached on the restoration of the status not in a year, but after 3 months. According to the President, PASO made changes 360 times in reporting to tax authorities during the year.

Describing the numerical composition of PASO, T.D. Butovchenko drew the attention of her colleagues to the alarming tendency to reduce it: “Last year 62 applicants joined the ranks of the Samara Bar, and 64 lawyers terminated their status. Meanwhile, the replenishment of the corporation should come at the expense of young lawyers, otherwise we will face stagnation, aging and reduction. "

T. Butovchenko focused the attention of the conference delegates on the most important aspects characterizing the activities of the PASO Council for the reporting period.

According to the speaker, the professionalism of the lawyers of the Samara region is highly appreciated by the self-government bodies at the federal level. So, since 2002, a representative of PASO has always been present in the Council of the FPA RF, the FPA RF Commission on Ethics and Standards. In addition, PASO is represented in such organizations as the Public and Expert Councils under the Ombudsman for Human Rights in the Samara Region, the Samara Regional Branch of the Russian Lawyers Association, the executive committee of which is headed by the Chairman of the PASO Qualification Commission A.V. Kokin, Public Council at the Main Directorate of the Ministry of Internal Affairs of Russia in the Samara Region. There is an agreement on free expert legal assistance with the Ombudsman for the Protection of the Rights of Entrepreneurs in the Samara Region.

As T.D. Butovchenko, the absolute pride of PASO and the focus of all control levers is the SUP Center. In 2020, the staff of the Center for Subsidized Legal Aid of the Chamber of Lawyers of the Samara Region was recognized as a laureate of the "Lawyer of the Year in the Samara Region" award in the category "Human Rights Activity".

“The coordinators of the SJP Center, - said Tatiana Dmitrievna, - withstood the most difficult period of pandemic restrictions, not allowing a single working day to be disrupted, providing almost a thousand PASO lawyers with guaranteed wages”. The volume of free legal aid distributed among lawyers in 2020 amounted to 54,165 cases.

In order to guarantee the quality of defense in cases according to appointment, the bodies of advocate self-government carry out control measures. In 2020, 349 lawyers passed such a test, which confirmed a fairly high level of lawyers' work. “Not a single lawyer has been brought to disciplinary responsibility on 32 initiated disciplinary proceedings. The identified shortcomings were eliminated, the Council recognized the violations as insignificant. This testifies to the fact that the quality of work in assignments is constantly increasing. "

The conference delegates also approved the news that, due to the high demand for the electronic procedure for visiting the pre-trial detention center, the PASO Council began negotiations with the administration of the pre-trial detention center and the Main Directorate of the Federal Penitentiary Service on the allocation of a third office for lawyers to work.

Highlighting the results of the work of the Chamber on the organization of professional development, the President of PASO reminded the delegates about the approaching target date for the implementation of the Standard (in the amount of 30 or 40 teaching hours, depending on the length of service) over the past year. The report provided very impressive figures. Thus, 1293 lawyers took part in 48 FPA RF webinars (288 academic hours). PASO held 4 training events (55 academic hours), 3 of which (15 academic hours) - free of charge. They were attended by 203 lawyers.

The volume of the teaching load at the School of the Young Lawyer was 100 academic hours (face-to-face and online classes). In 2020, 16 trainee lawyers completed training. The President of PASO expressed special gratitude to the leaders of the ShMA A.M. Izosimov, etc. Ivanova.

T.D.Butovchenko emphasized that according to the results of the audit carried out by the lawyers of the Samara region, the requirements of the Standard of professional training and professional development of lawyers and trainees of lawyers "distinguished" only 53 lawyers. However, all, with the exception of two, whose status was terminated, took urgent measures to remedy the situation. Thus, the PASO Council organized systematic and thorough work to organize professional development.

The reporting data on the disciplinary practice of the PASO cannot but rejoice. During the reporting period, the Chamber of Lawyers received 372 appeals (complaints / submissions) against the actions of lawyers. In 223 cases, there were no grounds and reasons for initiating disciplinary proceedings (60% of the appeals received). The figures indicate that the PASO cuts off unfounded complaints.

In 2020, 149 disciplinary proceedings were initiated, of which only 59 ended in disciplinary action. 24 remarks, 29 warnings were made, the status of 5 lawyers was terminated for non-payment of fees and loss of communication with the Bar Association. The status of just one lawyer was terminated for improper performance of professional duties.

90 disciplinary proceedings were terminated, including in 41 cases due to reconciliation, which testifies to the ability of the PASO Council to positively influence all participants in conflict situations.

Another priority area of ​​work of the PASO Council is the organization of information support for advocacy. Perhaps, in this area, the Samara Chamber is difficult to keep up with. The subject of well-deserved pride is the highly professional printed edition "Bulletin of the Chamber of Lawyers of the Samara Region". A mobile application has become an innovative resource for PASO in 2020. "PASO.ru". All the steps taken by the Chamber of Attorneys to save money in order to direct them to the development of a mobile application paid off. Most of the PASO lawyers have installed the application and are actively using it. And for lawyers working in the free legal aid system, this tool has become a must.

Thanks to specially developed software, lawyers - members of PASO - got a unique opportunity to interact with the chamber remotely, through their mobile devices, track information relevant to work in real time and respond promptly to it.

The conference delegates watched with pleasure a video about the work of the mobile application, which clearly demonstrates all the capabilities of the new communication tool.

According to Tatiana Butovchenko, the introduction of a mobile application is a breakthrough, providing Samara lawyers with confident leadership for many years to come. With loud applause, the delegates supported the confidence of the PASO President that the lawyers of the Samara region will not stop there and the country will more than once celebrate their phenomenal successes.

Dmitry Alekseevich Taraborin, a member of the PASO Council, made a report on the new realities of protection by appointment. In his opinion, the requirements for human rights defenders have become tougher, since an increase in the salary of a lawyer invariably entails increased control. Dmitry Alekseevich urged his colleagues to take a more balanced approach to filing applications for remuneration of their labor in cases of appointment.

Vice-President of PASO Natalia Yuryevna Sukhova for her report chose a topic that is looking to the future and related to the digitalization of the legal profession, in particular with the use of an enhanced qualified electronic signature. According to the speaker, the UKEP is the most state-regulated type of signature, which is already used in more than fifty areas. Natalia Yurievna spoke about her personal experience of obtaining and using an enhanced qualified electronic signature in the work of a lawyer and advocate education. According to N.Yu. Sukhovoy, the use of UKEP allows you to reduce the cost of maintaining document circulation and makes it possible to participate in electronic auctions for the provision of legal assistance.

Alexey Valerievich Kokin laconically told his colleagues about the work of the Qualification Commission in a new format - in connection with the amendments to the Federal Law "On advocacy and the legal profession in the Russian Federation" that came into force on 01.03.2020. According to the Chairman of the Qualification Commission, the work is well-organized, the commission does not work in opposition to the council. The number of complaints from principals has decreased.

A.V. Kokin assured those present that when considering disciplinary proceedings, all materials are very carefully studied. Addressing his colleagues, the chairman of the Qualification Commission urged, if disciplinary proceedings were initiated against them, to take all measures to professionally and on time build up their position before the commission.

Solutions

By an absolute majority of votes (one delegate voted against) the reports of the Council of the Chamber of Lawyers of the Samara Region, including on the execution of the estimate of income and expenses for the maintenance of the Chamber of Lawyers of the Samara Region, for the period from January 01 to December 31, 2020, were approved.

The results of the audit of the financial and economic activities of the Chamber of Lawyers of the Samara Region in 2020 were reported to the conference delegates by the chairman of the PASO Audit Commission, Lyudmila Ivanovna Altukhova. The delegates, having no reason to distrust the elected Audit Commission, unanimously approved the report.

There were no objections to the third and fourth issues on the agenda, concerning the cost estimate for the maintenance of the Samara Region Chamber of Lawyers for 2021, including the determination of the amount of compulsory contributions for the general needs of the Samara Region Chamber of Lawyers.
The conference decided:
To approve the estimate of income and expenses for the maintenance of the Chamber of Advocates of the Samara Region for the period from January 01, 2021 to December 31, 2021.

In case of exceeding the size of the income part of the estimate, the amount of the excess shall be directed to the maintenance of the Chamber of Lawyers of the Samara Region and its statutory activities in accordance with the lines of the expenditure part of the estimate.
Determine from January 01, 2021, the mandatory monthly deductions from each PASO lawyer for the general needs of the Chamber of Lawyers of the Samara Region (excluding deductions for the first month of membership in the Chamber of Lawyers of the Samara Region) in the amount of 1,600 (One thousand six hundred) rubles.

Change the amount of mandatory monthly deductions from each lawyer of the Chamber of Lawyers of the Samara Region for the general needs of the Chamber of Attorneys of the Samara Region (except for deductions for the first month of membership in the Chamber of Attorneys of the Samara Region) by the amount of the change in the amount of deductions for the general needs of the Federal Chamber of Lawyers of the Russian Federation, if such decisions by the next All-Russian Congress of Lawyers.

Determine the amount of mandatory deductions for the first month of membership in the Chamber of Lawyers of the Samara Region for the general needs of the Chamber of Lawyers of the Samara Region in 10 times the amount of the subsistence minimum in the Samara Region established by the Government of the Samara Region for the able-bodied population at the time of making the mandatory contributions.

Having exhausted the agenda and adopted unanimous decisions on all issues, the conference ended its work. And the lawyers did not disperse for a long time, rightly believing that the most important result of the conference is informal communication with their colleagues.
