On October 29, a regular meeting of the PASO Council took place.
Two applicants took an oath of allegiance to the lawyer's duty.
According to a personal statement, the status of one lawyer was suspended, and one application for a change in membership in the PASO in connection with the transfer of members of the bar association of another subject of the Russian Federation was satisfied.
The status of seven lawyers was terminated on personal application, in two cases - due to death.
The PASO Council approved the applications of five lawyers on the credit of hours of professional development listened to by lawyers in organizations of additional professional education licensed to carry out the relevant activities. In one case, the application was not satisfied because, at the time of its submission, the lawyer had already fulfilled the requirements of the Professional Training and Professional Development Standard for Lawyers and Lawyer Trainees for 2020. Clause 13 of the Standard stipulates the obligation of a lawyer to improve his qualifications annually in the amount of at least 30, and for lawyers with up to 3 years of experience - at least 40 hours per year. Upgrading the professional level in the amount of more hours is encouraged, but does not imply "postponing" these hours for the next year.
The Council approved the "Procedure for the provision of free legal advice to citizens by students of the" School of a Young Lawyer "project of the Chamber of Lawyers of the Samara Region, including using the Internet
The PASO Council satisfied the applications for the inclusion of 17 lawyers in the SJP system, the establishment of 7 and the liquidation of 4 lawyers' offices.
17 lawyers are included in the SJP PASO system to work in cases appointed by the bodies of inquiry, investigation and court.
The meeting of the Council was embellished by the presentation of the updated website of the Chamber of Lawyers of the Samara Region. Rumiya Rustamovna Abdryakhimova, a specialist in the development and maintenance of information resources, presented to the Council the possibilities of a new website adapted to work with a mobile application that will allow online generation and sending of documents to the SJJ Center (application for inclusion in the List of lawyers providing subsidized legal assistance; application for visiting the client containing in the SIZO; notification of the Subsidized Legal Aid Center about the conclusion of an agreement in the interests of a particular person; notification of the SJP Center about the suspension of activities for valid reasons, etc.); monitor the status of a personal account for the implementation of the Professional Training and Professional Development Standard for lawyers and law trainees and much more. The launch of the application is planned for December 2020.
During the meeting of the Council, 39 disciplinary proceedings were considered. The status of five lawyers was terminated: in four cases - due to systematic (more than 6 months) failure to fulfill obligations to deduct membership fees and the loss of communication with the chamber, the moratorium on acquiring the status was established by them for a period of one year.
Another lawyer for 6 years of work had already three warnings about the termination of the status, and the next complaint of the trustee, from which the lawyer took the fee, did not contribute to the current account of the lawyer's education, did not violate the order, did not get in touch, did not take part in the court proceedings - left the Council no choice. The former lawyer will be able to re-pass the status exam only after 3 years.
For the award "Lawyer of the Year in the Samara Region" in the nomination "Human Rights Activity", the Center for Law Enforcement PASO, represented by its head, Elena Vladimirovna Salnikova, was nominated. The SJP Center has been operating in the Chamber of Lawyers of the Samara Region since 2007. It was the first unified and independent center for assigning cases to appointments in the country through an electronic system and has definitely made an enormous contribution to protecting the rights of citizens from abuse by both law enforcement agencies and unscrupulous lawyers.
Based on the applications received from the principals, the Council expressed gratitude to 12 lawyers.
