Meeting of the PASO Qualification Commission

11/12/2020 chaired by A.V. Kokin, in a difficult epidemiological situation, a regular meeting of the Qualification Commission of the Chamber of Lawyers of the Samara Region took place.

The Commission considered 17 disciplinary proceedings, 7 of which were initiated on the proposal of the Vice-President of PASO on non-payment of membership fees, one - on the proposal of the Department of the Ministry of Justice in the Samara region.

Based on the results of consideration by the Commission:

- in seven cases of disciplinary proceedings on non-payment of membership fees, violations of the legislation on the Bar and the Code of Professional Ethics of a Lawyer were found;

- on one disciplinary proceeding initiated at the request of the court, the Commission came to the conclusion that the actions of the lawyer violated the legislation on the Bar and the Code of Professional Ethics of the Lawyer;

- five disciplinary proceedings were terminated due to the proper provision of legal assistance, the client's claims were recognized as unfounded;

- three disciplinary proceedings were terminated due to the withdrawal of the complaint (presentation, appeal) or the reconciliation of the person who filed the complaint and the lawyer;

- one disciplinary proceeding was postponed for a reason recognized by the Commission as valid.

The measure of disciplinary liability in relation to lawyers, in whose actions the Commission found violations of the legislation on the legal profession and the Code of Professional Ethics of a Lawyer, will be determined by the PASO Council at a meeting to be held on November 26, 2020.

Based on the results of passing the qualifying examination for conferring the status of a lawyer out of 31 admitted by the Qualification Commission in accordance with Art. 10 of the Law "On advocacy and the legal profession in the Russian Federation" of applicants, one applicant did not pass the test, three did not pass the oral part of the test

27 applicants successfully passed the qualification exam and were invited to take the oath to the next meeting of the Council of the Chamber of Lawyers of the Samara Region.
